I don't know if the man in the story & our friend are one in the same. The man in the news story does, coincidently have what appears to be a school bus, parked next to a canopy at his home.

I met the dude in person.. he got stranded in arkansas.. his bus broke or something? i was going from san antonio to ohio.. i drove him to memphis overnight.. he drove part of the way.. he drove my bus at 80 (grrr).. otherwise it was just talkin about race cars and hot rods..
I might recognize a pic..

Whoa, I did not expect there replies. I suspect the guy who attack me saw the damage he did to me to get out of he said I attacked him. I suspect he knocked me out then proceeded to stomp my . The police have never taken a statement from me. Can link any newspaper article about the incidence, I have not seen any. I have no memory of the incident other than him rushing me, lunging at me, and I remember nothing more till a woke up 3 days into rehab after spending 9 days in the hospital. I haven't even received a copy of the case report, I'm told I would receive one at the arraignment, I was told the preliminary hearing would be in Jan., yet here we are at the end of Feb. and no date has been set. No way did I attack an 18 year old kid, it's just not in my nature, I have no history of being violent. I suspect he saw the damage he did to me and to get out of trouble he filed the charges against me.

I just read the newspaper article, It was written 3 months after the incident when I got out of rehab. The Sheriffs didn't apprehend me, I drove to the Sheriffs office to get a copy the police report because they wouldn't tell me anything over the phone when I was in rehab. The article was based entirely on the police report with on input from me, based only on he said/he said. I never was asked my version events. The kid said he had "apparent" minor injuries, apparent means no one saw any injuries. I didn't have a tire iron in my vehicle.

From my experience, It's not uncommon for the perpetrator to switch the story of what happened in an incident Doing so makes it difficult for law enforcement to sort out the facts...lacking independent witnesses, it becomes a he said-she said situation.
So, with both stories being plausible, I'll with hold judgement...
another thought....anyone can defend themselves using reasonable force. However, once the threat has been neutralized, if you continue attacking your "attacker" then you may be committing a crime yourself.
I'm not qualified to give legal advise...only a lawyer can do that.
So, Marc...get a lawyer, they're not cheap but get one anyway.

Mark, I'm sorry to hear that. Hope you get some resolution in the matter.
I bought tires and wheels from Mark last year. Super nice and interesting guy. Sorry he lives a haul away or I think we'd hang out.
Mark isn't a big guy. At all. If I was his size and almost 70 years old it'd been a pistol in my hand if someone road-raged me.

The article states that it was written on november 22nd, the crime occurred on september 14(not 3 months later). The picture was taken on november 18th by the sheriff after booking into corrections. They booked into corrections because there was a warrant issued for your arrest. The picture looks pretty good for a man that went through 400+k of facial reconstruction and a 2 week hospital/rehab stay.
To be honest I have a real hard time believing the sheriff wouldn't arrest the other guy if they arrived at scene and you were laying on the ground knocked unconscious, with a broken nose, an eye out of socket, and your face/teeth kicked in. I know that if I pulled up to an assault and a guy is in that shape, whereas the other guy is perfectly fine, I'd have a hard time believing the guy that's beat to hell isn't the victim.
And if it was in a walmart parking lot, don't they all have cameras on the lot? Might not be crystal clear but it'd corroborate one story better then the other I would think.

esp after only 2 months!.. recovery from that kind of surgery would be a lot longer than 8-9 weeks!!
