It seems that many states don't say anything about it specifically (like my state, PA), but some (like California, Connecticut, Georgia and Massachusetts) basically require it to go out the back (or else up over the top). Vermont, the state my bus is registered in, requires it to be out the back or else out the side behind any openable windows (which in my case means it has to go out the back since I'm keeping all the original bus windows).
