I am having a hard time converting 97 mg to the US Blood Alcohol Concentration percentage (BAC). The closest I can figure is that he tested at the equivalent of a BAC of 0.103%

In the US, a BAC of 0.100% used to be the division between DWI or legal. But the Feds pressured all the states to change this to 0.080%.

The current levels in this state are:

0.040% - legal limit for commercial truck and bus drivers

0.060% - not DWI (intoxicated), but DWAI (driving while ability impaired) This is a misdemeanor. Often first offense DWI could be pleaded down to DWAI until the State Legislature forbade the practice.

0.080% - DWI, misdemeanor 1st offense, felony for children in the car or repeat offense. After 10 years, the previous offense does not count. The plea to DWAI was used to prevent any second offense being raised to a felony.

0.180% - Felony DWI, even first offense

Police often stop motorists operating with BAC of 0.240% to sometimes an extreme of 0.450%

It's not OK that Gurdeep put the students in jeopardy, and his BAC must have been receding at the time of the accident from a much higher level attained during the all-nighter. But the level of 0.103% would be equal to only 2 to 4 recent pints of beer, depending on the drinkers' body size.
 
I found, eons ago that my driving was rubbish after half a pint of beer. I was not over the limit but now have a self imposed 0.00% limit, above which I will not drive.
